Cancellation / Right of Withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods (the artwork / the print).

Exercising the right of withdrawal

To exercise the right of withdrawal, you must inform us (Finestartmanufactory.com (Prof. Dr. Love), Gentzgasse 123/5, 1180 Vienna, Austria, E-mail: finestartmanufactory@gmail.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached sample withdrawal form, but its use is not obligatory. In order to meet the withdrawal deadline it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal / Return & Refund

If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive notification of your decision to withdraw from this contract. For such reimbursement we will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees for such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You shall bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Please send the artwork / item preferably in its original packaging so that it arrives back to us undamaged and in its original condition. (This is helpful for organizational reasons, but is not a prerequisite for exercising the right of withdrawal.)


Damages and problems

Please inspect your order upon receipt and contact us immediately if the item is defective or damaged or if you received the wrong item so that we can assess and remedy the problem. You are only liable for any diminution in value of the artworks if that diminution results from handling that was not necessary to inspect the nature, characteristics and functioning of the goods.

  • Please notify damaged returns in advance, e.g. by e-mail. (For faster processing we ask you to send photos (front/back) when pre-registering the return. The photos are helpful for organizational reasons, but they are not a prerequisite for exercising the right of withdrawal.)

  • After receipt of the goods we carry out an inspection of condition (documented by photos / date).

  • If damage is found, we will inform you in writing without undue delay and state the basis of the calculation (e.g. conservator/restoration costs, cleaning costs, repair costs or loss in value). Refund amount = purchase price − (documentable restoration / cleaning / repair costs and/or diminution in value). We will provide you with the calculation on request.

Exceptions / Items not eligible for return

The right of withdrawal does not apply to contracts for the supply of goods which are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. This means specifically: commissioned and bespoke / individually personalized artworks (e.g. works produced according to your specifications) are excluded from the right of withdrawal. Standard prints and non-personalized originals remain withdrawable, provided they are returned undamaged.

Exchange 

Prof. Dr. Love intentionally produces small quantities of goods / uniques to limit overproduction. Outside the statutory right of withdrawal, we are unable to accept returns of purchased goods; therefore, exchanges are excluded.
